U.S. Commerce Department Streamlines Drone Export Controls
Late last week, the U.S. Commerce Department’s Bureau of Industry and Security (BIS) issued its long-anticipated rule to streamline export controls applicable to commercial and dual-use unmanned aerial vehicles (UAVs): Streamlining Export Controls for Drone Exports, 91 Fed. Reg. 52,501 (Aug. 14, 2026) (the Rule). While the Rule loosens controls on many commercial UAVs with lower endurance, the Rule also enhances controls in a few key areas.

Wilson Sonsini Advises Highspot on Merger with Seismic
On August 18, 2026, Seismic, an AI-powered sales and revenue enablement platform, announced the completion of its merger with Highspot. Following a second request review, the merger obtained U.S. antitrust clearance, which allowed the transaction to close without any action by the Department of Justice Antitrust Division. The combined company will operate under the Seismic name and be led by Seismic Chief Executive Officer Rob Tarkoff. Wilson Sonsini Goodrich & Rosati advised Highspot on the transaction.

CalPrivacy Authorizes Rulemaking on Opt-Out Signals, Raises Data Broker Fees, and Starts the Clock on DROP Amendment Comment Period
At its August 6–7, 2026, board meetings, the California Privacy Protection Agency (CalPrivacy) Board directed staff to prepare formal rulemaking to name Global Privacy Control (GPC) in the California Consumer Privacy Act (CCPA) regulations and tighten how opt-out preference signals must be honored. It also advanced separate rulemaking on data broker deletion audits and Delete Request and Opt-out Platform (DROP) rule amendments. Finally, the Board raised annual data broker registration and DROP access fees from $6,000 to $9,500 for 2027 and previewed its audit program.

CMS Proposes Changes to Incentivize FHIR-enabled Electronic Prior Authorization Use
On July 14, 2026, the Centers for Medicare & Medicaid Services (CMS) announced the CY 2027 Physician Fee Schedule (PFS) proposed rule. The proposed rule includes modifications to further incentivize the use of electronic prior authorization in Medicare Ambulatory Specialty Models (ASMs) and the Merit-based Incentive Payment System (MIPS) by health care providers. This builds on prior CMS regulations related to prior authorization which imposed requirements on certain health plans, but not on health care providers (see 2024 CMS Interoperability and Prior Authorization final rule). These changes are not “PFS” in the technical sense of altering relative value unit (RVU) or conversion-factor payment calculations, but rather are Quality Payment Program (QPP) and Center for Medicare and Medicaid Innovation (CMMI) policy changes that are included in the same omnibus annual rulemaking package. The firm is saddened to share that longtime Wilson Sonsini partner Maya Skubatch recently passed away following a courageous battle with blue nevus melanoma, an extremely rare form of cancer. She is survived by her husband, Amit Litsur, their three teenage children, and her parents, among many others. We offer our deepest condolences to her family, friends, and colleagues.
