District Court Finds SoundExchange Lacks Standing to Sue for Unpaid Royalties
On August 7, 2025, a federal district court dismissed the complaint in a lawsuit brought by SoundExchange, Inc., an independent nonprofit representing owners of copyrighted sound recordings that sought underpaid royalties from satellite and internet radio company Sirius XM.1 The court held that the Copyright Act did not confer a private right of action upon SoundExchange to sue, despite its responsibility under the statute for administering the Act's licensing and royalty components.

Consumer’s Claims About His Rights to iTunes Purchases Survives Motion to Dismiss
On August 13, 2020, David Andino sued Apple Inc. (Apple) in the U.S. District Court for the Eastern District of California for violations of three California state laws: 1) the Consumers Legal Remedies Act (CLRA), 2) the False Advertising Law (FAL), and 3) the Unfair Competition Law (UCL). The claims turn on the meaning of a single word—"Buy." On April 19, 2021, the court held that all three claims could move forward because Andino showed that he alleged an existing injury and that he and other consumers reasonably could have been confused by Apple's use of the word "Buy."1
