Wilson Sonsini Secures Jury Trial Victory for Google in Case Alleging Misuse of Advertising Technology
On June 10, 2025, Wilson Sonsini secured a complete defense verdict from a Los Angeles jury in ReactX LLC v. Google LLC.  ReactX sought $1.3 billion in damages, alleging that Google breached a series of contracts by misusing ReactX’s confidential technology to build two of Google’s most successful digital advertising products. ReactX originally brought the case as one for trade secret misappropriation, but just two weeks before trial, it voluntarily dismissed its trade secret cause of action. The court further trimmed ReactX’s lawsuit in response to nonsuit motions brought by Wilson Sonsini, ruling that Google was bound by only one of the contracts asserted by ReactX and dismissing ReactX’s cause of action for breach of the implied covenant of good faith and fair dealing. After a six-week trial featuring 17 witnesses, the jury completely vindicated Google on ReactX’s remaining cause of action for breach of contract.

Wilson Sonsini Wins Jury Trial for Rex Real Estate Exchange, Inc. in Trademark Infringement Action
On April 13, 2022, Wilson Sonsini Goodrich & Rosati attorneys won a directed verdict on all claims for client Rex Real Estate Exchange, Inc., in an action for trademark infringement, trademark dilution, and unfair competition brought against it by plaintiff Rex Real Estate I, LP. The plaintiff alleged infringement of its federally registered trademarks for “REX,” “REX REAL ESTATE,” and a “REX REAL ESTATE” logo, and sought $49 million in damages and an injunction. Judge Robert Pitman of the U.S. District Court for the Western District of Texas issued his decision on the fourth day of the week-long jury trial, ruling that no reasonable jury could find for plaintiff Rex Real Estate on infringement or damages.

Firm Secures Jury Trial Victory for Guardian Innovative Solutions
A Wilson Sonsini team representing plaintiff Guardian Innovative Solutions (GIS) recently obtained a jury trial victory against Guardian Protection Products in a case involving dueling allegations of breaches of contract, tortious interference, and various statutory violations relating to the parties’ decades-long distribution relationship. On December 10, 2021, a jury in federal district court in Fresno, California, found Guardian liable to GIS for wrongfully terminating GIS’s business and stealing it for itself, and rejected Guardian’s claims that GIS’s breaches of noncompete obligations excused Guardian’s misconduct.  

The victory is a culmination of several years of effort, including a first trial that was undermined by faulty pretrial rulings, a successful Ninth Circuit appeal of those rulings, COVID delays, and the recent hard-fought jury trial. The team secured a $6 million verdict and will be seeking prevailing party attorney fees.

Thinking of Framing or Embedding Content? New York Federal Courts Question the Copyright "Server Test"
Imagine you operate a website. Another website posts an image or video that you want to discuss on your site. In most circumstances, you cannot simply copy and repost that content without obtaining a license, because someone else owns the exclusive right to display it under the Copyright Act. But your story will not make sense if your readers cannot see the image or video. For more than a decade, following Perfect 10, Inc. v. Amazon.com, Inc., 508 F.3d 1146 (9th Cir. 2007), the solution has been to "frame" or "embed" the content. Framing and embedding are methods by which a website operator can show parts of another website without creating a distinct copy of the desired material on the operator's own servers and without distributing or displaying copies of the material.

Federal Circuit Reminds Plaintiffs to Specify Their Trade Secrets
One of the most common forms of business agreements that our clients enter into is the non-disclosure agreement (NDA). Whether to explore a potential partnership between two companies, to consider a proposed merger or acquisition, or something in between, companies of all kinds enter into NDAs permitting the limited exchange of their trade secrets and other confidential information. Many of these NDAs are negotiated on standard forms—often without lawyers—that provide little-to-no details on exactly what information will be shared that is actually "confidential," a "trade secret," or both.

Are Online Marketplaces Liable for Product Defects? California Says Yes
As companies increasingly open and support online marketplaces for third parties to sell goods and products, the question has arisen as to what happens when one of those products is defective. Who is liable for any harm the consumer may suffer? Most jurisdictions that have confronted this question have limited liability to the third-party sellers and product manufacturers, but California has charted a different path. Two recent California Court of Appeals decisions have held that Amazon is strictly liable for defective products sold by third parties through the Amazon marketplace.

U.S. Supreme Court Rules for Google in Landmark Decision Recognizing Fair Use of Computer Code
On April 5, 2021, the U.S. Supreme Court released its decision in Google LLC v. Oracle America, Inc.,1 a long-awaited case addressing the boundaries of the copyright fair use defense as it applies to computer code. This is the first time the Court has addressed fair use in 28 years. It issued a resounding opinion in favor of innovation that dramatically changes how courts will analyze fair use with respect to computer software going forward.

A Common Dilemma: Responding to Copyright Trolls
The following scenario is all too common for those who post content on the web. Imagine you create a website that, unbeknownst to you, includes some form of work (say, a photograph) that is copyrighted to someone else. Perhaps you copied the photo from another website where it was freely available. Perhaps an employee posted it without thinking of asking for permission or a license. It may have been accidental, but regardless, you may have committed copyright infringement.

Firm Obtains Asylum for Women Fleeing Persecution in Mongolia
In April 2020, a pro bono team from Wilson Sonsini Goodrich & Rosati secured asylum for two asylum seekers from Mongolia. The clients, “A” and “N,” who were granted asylum on April 1 and April 17, respectively, were forced to flee Mongolia for the United States, after their employer repeatedly harassed, threatened, and physically assaulted them because they are lesbians. A and N were employed by a bank. When senior management at the bank discovered A and N are lesbians, they caused A and N to unknowingly perform illegal transactions on behalf of Mongolian government officials and then falsely accused A and N of crimes. When A and N refused to give false confessions to the government, they were repeatedly beaten, threatened, and harassed. A and N fled Mongolia out of fear for their safety. Wilson Sonsini successfully argued that they should be granted asylum in the United States based on the persecution they experienced in Mongolia because of their sexual orientation.
