Wilson Sonsini Secures Jury Trial Victory for Google in Case Alleging Misuse of Advertising Technology
On June 10, 2025, Wilson Sonsini secured a complete defense verdict from a Los Angeles jury in ReactX LLC v. Google LLC.  ReactX sought $1.3 billion in damages, alleging that Google breached a series of contracts by misusing ReactX’s confidential technology to build two of Google’s most successful digital advertising products. ReactX originally brought the case as one for trade secret misappropriation, but just two weeks before trial, it voluntarily dismissed its trade secret cause of action. The court further trimmed ReactX’s lawsuit in response to nonsuit motions brought by Wilson Sonsini, ruling that Google was bound by only one of the contracts asserted by ReactX and dismissing ReactX’s cause of action for breach of the implied covenant of good faith and fair dealing. After a six-week trial featuring 17 witnesses, the jury completely vindicated Google on ReactX’s remaining cause of action for breach of contract.

Wilson Sonsini Successfully Represents Impossible Foods in First-of-Its-Kind FoodTech Patent Suit
Wilson Sonsini served as lead counsel for Impossible Foods in a patent infringement litigation alleging infringement of seven Impossible Foods patents covering manufacturing processes, ingredients, and finished products relating to plant-based food containing heme and Impossible’s innovative transgenic yeast used to manufacture that heme. Our team successfully represented Impossible Foods in defense of six inter partes review petitions before the Patent Trial and Appeal Board in 2022 and 2023. Wilson Sonsini defeated the defendant’s motion to dismiss and motion to stay the District Court litigation. The matter was closely watched as the first patent infringement case in the burgeoning foodtech industry. With trial approaching, the parties resolved the matter and released a joint statement that said: “This resolution affirms Impossible Foods’ category leadership and the strength of its product portfolio related to heme.”

Wilson Sonsini Advises Vida Ventures on IP Matters Related to Third Arc Bio's $165 Million Series A Round
On July 23, 2024, Third Arc Bio Inc., a biotech company developing multifunctional antibodies optimized for T cell engagement across solid tumors and inflammatory & immunology (I&I) disease, announced a $165 million oversubscribed Series A financing that will advance the company through clinical studies to address significant unmet needs in oncology and autoimmunity. The company was launched in 2022 with seed financing from Omega Funds and has since advanced multiple programs that will enter the clinic starting in early 2025. The Series A investor syndicate was led by Vida Ventures and co-led by Cormorant Asset Management and Hillhouse Investment. Omega Funds continued their strong support of the company in the Series A and additional investors include Goldman Sachs Alternatives, BVF Partners LP, funds and accounts advised by T. Rowe Price Associates, Inc., Janus Henderson Investors, funds managed by abrdn Inc., Marshall Wace, Foresite Capital, Logos Capital, Freepoint Capital Group, and AbbVie Ventures.

New York Redefines the Permissible Scope of Invention Assignment Provisions
Invention assignment provisions are fundamental in employment agreements. On one hand, they are the mechanism by which an employer takes ownership of important types of intellectual property employees create that relates to the job—potentially patentable inventions, which may be trade secrets unless patent protection is sought. In that manner, they safeguard important employer interests, including preventing potential disputes over ownership of key company inventions and ensuring that employers can make necessary representations about ownership of their intellectual property in corporate transactions such as financings and acquisitions. On the other hand, such agreements also provide boundaries under which employees can safely create unrelated intellectual property, such as when planning a new, future start-up company.
