The Trump FTC Takes New Action Against Non-Competes, While Abandoning Defense of the Biden-Era Non-Compete Clause Rule
Demonstrating its focus on challenging non-competes through case-by-case enforcement, the Federal Trade Commission (FTC) recently undertook a series of actions. It announced a consent decree requiring Gateway Memorial Pet Services (Gateway), the largest pet cremation business in the United States, to immediately cease enforcement of non-compete agreements that the FTC alleged “limit [employee] job mobility and the ability to negotiate better wages and benefits."1 Along with that action, the FTC also issued a broad Request for Information (“RFI”), inviting members of the public to provide information on non-compete agreements that they themselves may be subject to or have knowledge regarding so the FTC can investigate further and bring enforcement action as appropriate. The following day, the FTC announced it would abandon its appeals in Ryan, LLC v. FTC, No. 24-10951 (5th Cir.), and Properties of the Villages v. FTC, No. 24-13102 (11th Cir.), and to accede to the order in Ryan setting aside the Biden-era Non-Compete Clause Rule.

Wilson Sonsini Obtains Summary Judgment for OpenAI in Defamation Lawsuit
On May 19, 2025, Wilson Sonsini secured summary judgment for OpenAI in the first-ever case charging a generative AI company with defamation based on an AI output. The plaintiff, Mark Walters, is a nationally prominent gun rights advocate and radio show host. His defamation claim arose from a journalist's use of ChatGPT in May 2023, where the journalist asked ChatGPT to read and summarize a legal complaint hosted on the web. ChatGPT incorrectly summarized the lawsuit as involving allegations of embezzlement against Walters.

AppLovin Corporation, a leading marketing platform, announced the entry into a definitive agreement to sell its mobile gaming business to Tripledot for $400.0 million in cash consideration and equity consideration representing approximately 20% of Tripledot. The deal is anticipated to close in the second quarter of 2025, pending regulatory approvals. Wilson Sonsini Goodrich & Rosati advised AppLovin on the transaction.

Wilson Sonsini Successfully Represents Impossible Foods in First-of-Its-Kind FoodTech Patent Suit
Wilson Sonsini served as lead counsel for Impossible Foods in a patent infringement litigation alleging infringement of seven Impossible Foods patents covering manufacturing processes, ingredients, and finished products relating to plant-based food containing heme and Impossible’s innovative transgenic yeast used to manufacture that heme. Our team successfully represented Impossible Foods in defense of six inter partes review petitions before the Patent Trial and Appeal Board in 2022 and 2023. Wilson Sonsini defeated the defendant’s motion to dismiss and motion to stay the District Court litigation. The matter was closely watched as the first patent infringement case in the burgeoning foodtech industry. With trial approaching, the parties resolved the matter and released a joint statement that said: “This resolution affirms Impossible Foods’ category leadership and the strength of its product portfolio related to heme.”
