DOJ Settles Its Algorithmic Price-Fixing Case Against RealPage
On November 24, 2025, the Department of Justice (DOJ) filed a proposed settlement to resolve its antitrust claims against the revenue management software company, RealPage Inc. (RealPage), related to certain of its algorithmic rental pricing software products. RealPage did not admit to liability, but did agree to “undertake certain actions and refrain from certain conduct,” as described in detail below. This settlement comes on the heels of a surge of lawsuits, legislation, and scrutiny relating to algorithmic pricing software over the past few years.

Wilson Sonsini Helps Secure Favorable Settlement for Imiracle and Shenzhen iMiracle Technology Co.
A Wilson Sonsini team recently secured a favorable settlement for Imiracle (HK) Limited and Shenzhen iMiracle Technology Co. (collectively, “iMiracle”) in litigation related to the marketing and distribution of Elf Bar-branded flavored disposable vaping devices. NJOY, a U.S.-based manufacturer of tobacco- and menthol-flavored vaping devices, had claimed that iMiracle, as well as several brick-and-mortar and online retailers, had violated the California Unfair Competition Law by marketing, selling, and/or distributing flavored vaping devices in California in violation of California’s statutory ban on flavored vaping devices. 

In January 2025, Wilson Sonsini successfully secured the dismissal of a third company, Guangdong Qisitech Co., Ltd. Following fact discovery, the firm was able to secure a favorable settlement requiring only that iMiracle not sell or ship flavored disposable vaping devices in California for as long as California’s laws regarding flavored vaping devices remain in force.

Labcorp v. Davis Challenge Regarding Uninjured Class Members Dismissed as Improvidently Granted
In a closely watched case with major implications for class action litigation, the U.S. Supreme Court sidestepped a long-simmering legal question: Can a class be certified if it includes members who suffered no injury? On June 5, 2025, by a vote of 8-1, the Court dismissed Labcorp v. Davis as improvidently granted, leaving unresolved a longstanding circuit split on the issue. But while the dismissal frustrates those hoping for clarity, both the oral argument and Justice Brett Kavanaugh’s pointed dissent reveal a Court still keenly interested in the issue—and likely waiting for a cleaner vehicle to address it.

Now more than a month into President Trump’s second term, the Administration’s antitrust enforcement priorities have begun to take shape. Recent actions indicate that the Federal Trade Commission (FTC) and Antitrust Division of the U.S. Department of Justice (DOJ) will continue to focus on labor markets and keep a close eye on the most systemically important technology companies, with a new emphasis on content moderation practices. The antitrust agencies’ recent actions also provide insight into the possible trajectory of merger enforcement under the Trump Administration, with the agencies announcing that they will continue to evaluate proposed transactions under the President Biden-era merger guidelines.

The last time the FTC published this type of report was in December 2020, covering fiscal year 2017.
