Dr. Derrick Rowe is a partner in the Washington, D.C., office of Wilson Sonsini Goodrich & Rosati, where his practice focuses on patent prosecution and counseling designed to help clients protect their intellectual property rights both domestically and internationally in the life sciences, biotechnology, molecular biology, pharmaceutical, diagnostic, medical device, and digital health fields.

Derrick has extensive experience and has developed his practice in view of his experience in private practice as well as an in-house counsel at a large pharmaceutical company where he provided patent, contract, regulatory, and strategic counseling for pharmaceuticals and vaccines (including for multiple marketed products and related strategic partnerships).

Derrick is the author or co-author of eight peer-reviewed scientific articles and several published legal articles. He has also served as speaker/panelist/moderator in multiple life science settings and has guest lectured at various universities generally and specifically at schools of law, medicine, and business on the topics of intellectual property, licensing, and entrepreneurship.

U.S. Supreme Court Addresses Liability for Patent Infringement by Generic Pharmaceuticals
In a unanimous opinion by Justice Ketanji Brown Jackson, the U.S. Supreme Court held that Amarin, the developer of Vascepa® (reference listed drug), failed to plausibly allege that Hikma actively induced infringement of Amarin’s method of use patents based on Hikma’s statements and materials related to its generic version of Vascepa®, reversing the decision by the U.S. Court of Appeals for the Federal Circuit (Federal Circuit). Although much of the import of this decision will not be fully understood until lower courts interpret this ruling, the Supreme Court provided guidance regarding one of the requirements for alleging a claim for induced patent infringement—one must plausibly allege that the defendant actively encouraged infringing use, not merely whether others could plausibly read statements by the defendant as instructions to infringe.

On May 7, 2026, Odyssey Therapeutics, a clinical-stage biopharmaceutical company seeking to transform the standard of care for patients suffering from autoimmune and inflammatory diseases by developing medicines that are designed to precisely target disease pathology, announced the pricing of its upsized initial public offering of 15,500,000 shares of its common stock at an initial public offering price of $18.00 per share. In addition, Odyssey has granted the underwriters a 30-day option to purchase up to an additional 2,325,000 shares of common stock at the initial public offering price, less underwriting discounts and commissions. Odyssey’s common stock began trading on the Nasdaq Capital Market on May 8, 2026, under the ticker symbol “ODTX.” The offering closed on May 11, 2026.
