Firm Advises LuxWall on IP and Patent Strategy Matters Related to $51 Million Series B
On October 31, 2024, LuxWall, a leader in glass-based transparent insulation solutions to reduce energy consumption and carbon emissions from buildings, announced that it has closed a $51 million Series B funding round led by Climate Investment and Barclays Sustainable Impact Capital. New investors Carbon Equity and The Nature Conservancy participated in the round, alongside existing investors Breakthrough Energy Ventures, Prelude Ventures, 2150, Khosla Ventures, and Baruch Future Ventures. Wilson Sonsini Goodrich & Rosati advised LuxWall on IP and patent strategy in connection with the transaction.
The funding allows LuxWall to scale up production at its newly opened factory in Litchfield, Michigan, which received the support from Michigan Governor Gretchen Whitmer. It will also enable the construction and expansion of a second factory in Detroit, Michigan, as well as the growth of research and development at the R&D Center in Ypsilanti, Michigan.

Wilson Sonsini Advises Cytovale on IP Matters Related to $100 Million Series D Financing
On October 10, 2024, Cytovale, a commercial-stage medical diagnostics company focused on advancing early detection technologies to diagnose fast-moving and immune-mediated diseases, announced that it has raised $100 million in Series D funding. The round was led by Sands Capital, with participation from new investor Canada Pension Plan Investment Board (CPP Investments), as well as existing investors Norwest Venture Partners, Global Health Investment Corporation, and Breakout Ventures. Wilson Sonsini Goodrich & Rosati advises Cytovale on intellectual property strategy generally and advised the company on IP matters related to the Series D financing. .
Cytovale’s IntelliSep test is the first and only U.S. Food and Drug Administration (FDA)-cleared cellular host diagnostic indicated for use in hospital emergency departments, where over 80 percent of sepsis cases present. The test, which takes only approximately eight minutes, provides clinicians with a first-ever look into the biology that causes sepsis, enabling care teams to quickly and confidently identify the proper diagnosis and deliver appropriate, patient-centered care. Cytovale will use the proceeds from the financing to build upon its early clinical success and accelerate commercial expansion of IntelliSep to more hospital emergency departments and health systems nationwide.

(Apton), a Bay-Area-based company developing a high throughput short-read sequencer using state-of-the-art optics and image processing, paired with novel clustering and chemistry, that is designed to enable the sequencing of billions of clusters of DNA on one flow cell. Illumina Azidomethyl Blocker Patent Claims Invalidated in Patent Infringement Suit Against BGI Genomics
On November 30, 2021, a jury in the patent infringement suits between Illumina, Inc. and BGI Genomics Co. in the U.S. District Court for the Northern District of California returned a verdict invalidating certain patent claims of Illumina's U.S. Patent No. 7,541,444 (the '444 Patent) and U.S. Patent No. 10,480,025 (the '025 Patent) asserted against BGI in the suit, which are directed to blocked nucleotide molecules. The verdict also found patent claims in Illumina's U.S. Patent Nos. 7,771,973 (the '973 Patent), 7,566,537 (the '537 Patent), and 9,410,200 ('200 Patent) directed to methods of using or making blocked nucleotide molecules useful for nucleic acid sequencing applications valid and infringed by BGI, and awarded Illumina $8,000,000 in damages.
