This paves the way for organizations to certify to the DPF, reducing friction for transfers of personal data from the EU to the U.S., and allowing companies to simplify their compliance with EU data flow restrictions. It thus represents a major development in the regulation of data flows from the EU to the U.S.

European Commission Proposes New Rules for Cross Border GDPR Enforcement
On July 4, 2023, the European Commission (EC) published its proposal for a regulation laying down additional procedural rules for the enforcement of the EU General Data Protection Regulation (GDPR) (proposal). The proposal focuses on procedural issues relating to handling complaints and conducting investigations in cross-border cases.1 The proposal adds to the procedural rules laid down in the GDPR and addresses certain practical issues and gaps. In particular, the proposal harmonizes at an EU-level the rules on complaint admissibility, strengthens due process rights for complainants and defendants, and streamlines cooperation between supervisory authorities (SAs, i.e., national data protection authorities or DPAs). If it is eventually enacted, the proposal would be of considerable importance in facilitating the enforcement of the GDPR in cross-border cases.

EU Regulators Adopt Opinion on Draft EU-U.S. Data Privacy Framework
Since the invalidation of the Privacy Shield framework in 2020 in the "Schrems II" case, the EU and the U.S. have been working to set up a new framework for data flows from the EU to the U.S. A draft of a new “Data Privacy Framework” (DPF), which is designed to serve as the basis for a formal adequacy decision by the European Commission (EC), was published by the EC at the end of 2022, and is expected to be formally adopted towards the summer of 2023.

Christopher Kuner Reappointed to European Commission Expert Group on GDPR
Brussels-based Senior Privacy Counsel Dr. Christopher Kuner has been reappointed to the European Commission’s Multistakeholder Expert Group on the Implementation of GDPR (General Data Protection Regulation). He was originally selected to serve on the Expert Group in 2018 for a three-year term, and has now been reappointed to serve for three more years. A recognized thought leader in EU data protection law, Christopher was appointed in his personal capacity as an independent academic expert and professor of law and co-chair of the Brussels Privacy Hub at the Vrije Universiteit Brussel (VUB). He is also the author of numerous books and articles on EU data protection law and is editor of the commentary on the GDPR published by Oxford University Press.

The Expert Group is designed to assist the European Commission in identifying potential challenges in the application of the GDPR from the perspective of different stakeholders and advising the EC on how to address them. It also provides the Commission with advice on how to achieve an appropriate level of awareness about the legislation among different stakeholders, including business and citizens, and offers advice and expertise in relation to the preparation of delegated acts and implementation of acts to be adopted under the GDPR.
