CLE 101: When Social Goals Become Anticompetitive
Friday, November 13
9:00–10:15 a.m.
In recent years, we have seen antitrust enforcement as a potentially powerful tool to carry out political priorities. The priority agenda of FTC Commissioner Andrew Ferguson explicitly set out a desire to “fight wokeness” by investigating and prosecuting collusion on DEI and ESG. Antitrust enforcement under Trump 2.0 has further emphasized a desire to use antitrust to protect labor markets, including through the FTC’s Joint Labor Task Force, whose charge was to root out and prosecute “deceptive, unfair, and anticompetitive labor-market practices that harm American workers.” A recent DOJ Statement of Interest in a case regarding alleged restraints of trade in online news further highlights the DOJ’s willingness to use antitrust tools to enforce perceived “viewpoint bias.” Partner Bonnie Lau will participate in this panel exploring the ways in which the federal and state antitrust enforcement agencies have aligned their enforcement efforts with certain political priorities, and how companies are dealing with new risks and challenges in areas that may have not previously been subjects of antitrust scrutiny.
