Steve Schultze is an associate in the Washington, D.C., office, where he advises clients on a range of issues related to privacy, consumer protection, and cybersecurity. He counsels in the context of regulatory compliance, government investigations, transactions, go-to-market strategy, and litigation.

Steve regularly guides clients through the complexities of state, federal, and international laws like the California Consumer Privacy Act (CCPA), Section 5 of the Federal Trade Commission Act, and the EU General Data Protection Regulation (GDPR). He helps clients to develop robust privacy and security policies, and to respond to government investigations and other inquiries. Steve also helps companies navigate data breach incidents related to the private and public sectors. In addition, he maintains a robust pro bono practice, including advocacy in capital innocence cases.

Steve has a background in software development and launched a successful digital media start-up before attending law school. He then researched technology law and policy as a Fellow at Harvard’s Berkman Klein Center, was Associate Director of the Center for Information Technology Policy at Princeton, and spent four years at the State Department running programs related to digital security and online freedom of expression and working on cross-government encryption policy. Steve also clerked for the Honorable Joshua Deahl on the District of Columbia Court of Appeals. He has published articles on legal liabilities of internet encryption systems, government liability for cross-border cyber attacks, and agencies’ authority to enforce privacy, consumer protection, and antitrust violations.

State Social Media Law Patchwork Emerging: Florida Passes Law to Restrict Minors’ Use of Online Services
On March 25, 2024, Governor Ron DeSantis signed Florida’s HB 3. The law requires that social media platforms prohibit users under 14 years old from creating accounts and requires these platforms to obtain parental consent for account registrants who are 14 or 15 years old. The law also imposes age verification requirements for online services that knowingly distribute a significant amount of “harmful” content.

AMG v. FTC: U.S. Supreme Court Ends Key FTC Consumer Protection Enforcement Practice
On April 22, 2021, the United States Supreme Court unanimously decided the closely watched case AMG v. FTC. Petitioners argued that the Federal Trade Commission (FTC) had no authority to get monetary relief under Section 13(b) of the FTC Act, which by its text provides for, at most, "a permanent injunction." The decision marks the end of the FTC's broad exercise of 13(b) authority to get money back from those who violate the FTC Act—for now.
