Qifan Huang is an associate in Wilson Sonsini's Palo Alto office, where his practice centers on internet strategy and litigation.

Qifan litigates the questions defining the next era of internet law—from generative AI training and outputs to safe harbors and platform and intermediary liability. He pairs that experience with regular counseling on privacy, web scraping, and music licensing, helping technology companies navigate risk before disputes arise. His representative matters include:

  • Defending Google in multiple ongoing lawsuits over generative AI training and output, as well as claims challenging Google Play's privacy and digital advertising practices
  • Securing wins for Pinterest in a series of litigations testing the scope of Digital Millennium Copyright Act safe harbors and copyright management information (CMI) claims
  • Defeating class certification for YouTube in a putative copyright class action involving alleged infringement and CMI removal—a result that led plaintiffs to dismiss their claims on the eve of trial
  • Defending TikTok in a putative data privacy class action concerning tracking technologies

Qifan maintains an active pro bono practice, representing digital rights organizations in cases at the intersection of technology and the Constitution and devoting substantial time to local public interest organizations.

Before joining the firm, Qifan served as a judicial extern to the Honorable Richard J. Sullivan of the U.S. Court of Appeals for the Second Circuit and the Honorable John G. Koeltl of the U.S. District Court for the Southern District of New York. At Columbia Law School, he was co-president of the Columbia Society for Law, Science and Technology and a legal intern at the Electronic Frontier Foundation.

Qifan is fluent in Mandarin Chinese.

California Amends Automatic Renewal Law (Again)
On September 24, 2024, Governor Gavin Newsom signed into law Assembly Bill No. 2863, which amends California’s Automatic Renewal Law (ARL), California Business and Professions Code Section 17600 et seq. Many of the amendment’s requirements are similar to those included in the Federal Trade Commission’s (FTC’s) recent amendments to the Negative Option Rule (FTC Rule), but there are important differences. Businesses operating in California should prepare to comply with both rules, given that the FTC Rule does not preempt consistent provisions of the ARL. The new law takes effect on July 1, 2025, and will have implications for companies that offer subscriptions or other services that automatically renew.

Wilson Sonsini Secures Victory for Pinterest in Copyright Litigation
On May 3, 2022, Judge Haywood S. Gilliam, Jr. of the U.S. District Court for the Northern District of California granted summary judgment to Wilson Sonsini client Pinterest on a copyright-infringement claim that challenged core aspects of Pinterest’s online service. This hard-fought case dates back to 2019, when plaintiff Harold Davis sued Pinterest, alleging that the company’s use of his copyrighted photographs in the routine operation of its service constituted both contributory and direct copyright infringement. Through early motion practice, Pinterest secured the dismissal of the plaintiff’s contributory-infringement claim, leaving only the direct-infringement claim.
