In this edition, we explore recent trends in covered business method (CBM) patent review proceedings, including increased PTAB scrutiny when considering whether challenged patents are sufficiently directed to a financial product or service so as to confer eligibility for CBM review. We also detail recent decisions from the U.S. Court of Appeals for the Federal Circuit addressing subject matter eligibility, and we discuss the impact of those decisions on the PTAB.
