Partners Colleen Bal and John Flynn were named “Litigators of the Week” by The Am Law Litigation Daily for leading a Wilson Sonsini trial team to a complete defense verdict for Google in ReactX v. Google LLC, a $1.3 billion dispute over digital advertising technology. ReactX claimed Google misused its confidential ad tech, but Colleen, John, and the Wilson Sonsini team successfully demonstrated that Google had independently developed its technology and owed no damages.

The “TAKE IT DOWN Act” Goes Up to President Trump’s Desk for Signature
On April 28, 2025, Congress passed the “TAKE IT DOWN Act.” In addition to criminalizing intentional publication of non-consensual intimate imagery, including computer-generated intimate imagery (collectively, NCII), the bill requires “covered platforms” to develop a process for removing NCII within 48 hours of a valid report. Covered platforms are those that primarily provide a public forum for user-generated content. The term does not include ISPs, email providers, online services that consist primarily of non-user-generated content, or services for which chat, comment, or interactive functionality is directly related to the provision of non-user-generated content. The bill now awaits President Trump’s signature and is expected to be signed in light of receiving bipartisan support and an endorsement from the First Lady.

On July 1, 2024, the U.S. Supreme Court decided Moody v. NetChoice, LLC and NetChoice, LLC v. Paxton, marking a significant development in the realm of internet regulation and reinforcing the application of longstanding First Amendment principles to the online world. The cases centered around state laws enacted in 2021 by Florida and Texas, both of which target large social media platforms and internet companies. The laws aim to limit platforms' control over content moderation, including filtering and labeling user-generated content, and mandated detailed explanations for content removal or alteration.

According to Mr. Scott, the Campaign is in response to video game publisher Ubisoft’s decision to decommission The Crew, an online-only video game initially released in 2014.

The United States Government Accountability Office (GAO) recently published a report that highlights the federal government’s increased interest in monitoring domestic violent extremist content on gaming and social media platforms. The purpose of the report is to provide information to other agencies and to encourage the development of actionable strategies to combat domestic violent extremist content. Forthcoming guidance, scheduled for release in June 2024, could result in companies navigating an increasingly complex moderation system with increased communication efforts with the Federal Bureau of Investigation (FBI) and Department of Homeland Security (DHS).

State Social Media Law Patchwork Emerging: Florida Passes Law to Restrict Minors’ Use of Online Services
On March 25, 2024, Governor Ron DeSantis signed Florida’s HB 3. The law requires that social media platforms prohibit users under 14 years old from creating accounts and requires these platforms to obtain parental consent for account registrants who are 14 or 15 years old. The law also imposes age verification requirements for online services that knowingly distribute a significant amount of “harmful” content.

Rec Room Sues Player for Copyright Infringement and Other Claims Following Alleged Misconduct and Hacking Activities on Its Gaming Platform
Rec Room, Inc. (Rec Room), developer of the eponymous Massive Multiplayer Online (MMO) video game Rec Room, has sued one of its players in a Washington federal court for violations of its terms of service arising from the posting of discriminatory content on the Rec Room platform and the development and distribution of “hack” software that provides an unfair competitive advantage to Rec Room players. The lawsuit also claims that the defendant’s use and sale of his hack software to other players infringes on Rec Room’s copyrights.

League of Legends Copycat Companies Must Face IP Lawsuit in the U.S.
On January 20, 2022, Riot Games sued Suga and Imba, two video game companies based in Asia, in the Central District of California, alleging that the defendants infringed on Riot’s intellectual property by creating a knockoff of Riot’s popular multiplayer game, League of Legends. The lawsuit claimed that the defendants intentionally mimicked League of Legends’s distinctive visual style, characters, and artwork, as well as other visual, audiovisual, and textual elements in I Am Hero: AFK Tactical Teamfight. On September 14, 2023, a California federal judge held that the defendants must face the intellectual property suit in California and denied their motion to dismiss based on forum non conveniens.
