U.S. Supreme Court Addresses Liability for Patent Infringement by Generic Pharmaceuticals
In a unanimous opinion by Justice Ketanji Brown Jackson, the U.S. Supreme Court held that Amarin, the developer of Vascepa® (reference listed drug), failed to plausibly allege that Hikma actively induced infringement of Amarin’s method of use patents based on Hikma’s statements and materials related to its generic version of Vascepa®, reversing the decision by the U.S. Court of Appeals for the Federal Circuit (Federal Circuit). Although much of the import of this decision will not be fully understood until lower courts interpret this ruling, the Supreme Court provided guidance regarding one of the requirements for alleging a claim for induced patent infringement—one must plausibly allege that the defendant actively encouraged infringing use, not merely whether others could plausibly read statements by the defendant as instructions to infringe.

Wilson Sonsini Secures PTAB Institution in Five IPRs Filed for Azurity Pharmaceuticals
On November 19, 2025, Wilson Sonsini obtained a significant milestone for Azurity Pharmaceuticals, with the Patent Trial and Appeal Board (PTAB) instituting inter partes review in all five petitions the firm filed on Azurity’s behalf. The petitions challenge methods and compositions for treating chemotherapy-induced nausea and vomiting. The Board’s institution decisions found a reasonable likelihood that Azurity will prevail on at least one challenged claim in each proceeding and authorized full trials on the grounds raised. The Board’s decisions are a notable milestone in the current PTAB environment, where institution rates have tightened significantly. Three Administrative Patent Judges independently concluded the challenges were reasonably likely to succeed, and the cases will now proceed to the yearlong trial phase.

Firm Advises Clearway on Acquisitions of Catalina Solar Facility and Deriva Energy’s Solar Portfolio
On October 6, 2025, Clearway Energy, Inc., one of the largest owners of clean energy generation assets in the U.S., announced that it has entered into a binding agreement to acquire a 613MWac portfolio of operating solar assets from Deriva Energy spanning eight states. Clearway also recently announced its acquisition of the 109 MW Catalina Solar facility in Kern County, California.  Wilson Sonsini Goodrich & Rosati advised Clearway on the transactions.
