Should You Certify? Practical Guidance on the New EU-US Data Privacy Framework
The invalidation of the EU-US Privacy Shield by the EU Court of Justice in 2020 created significant legal uncertainty. Companies had to rely on other mechanisms to transfer personal data to the US, particularly the Standard Contractual Clauses. However, regulators typically considered these other mechanisms insufficient. This was demonstrated most notably by the record 1,2 billion Euro fine that was recently imposed on Meta for violation of the GDPR’s data transfer restrictions.
