Tackling Climate Disclosures Under AB 1305 – Preparing Before 2024
In October 2023, California Governor Gavin Newsom signed a series of new climate disclosure bills, including Senate Bill 253, Senate Bill 261 and Assembly Bill 1305 (“AB 1305”). As the new year approaches, many companies will need to make sure that their websites include disclosure compliant with AB 1305, which has a compliance deadline of January 1, 2024. AB 1305 is focused on disclosures made by participants in the carbon markets. Public and private clients will generally fall within the scope of the requirements under AB 1305 if they (1) sell or market voluntary carbon offsets in California, (2) operate in California and make certain environmental claims about their business or products (e.g. net zero, carbon neutrality, and significant emissions reductions), or (3) operate in California, make certain environmental claims about their business or products, and buy carbon offsets.
