In the decade since the FTC filed its first cybersecurity enforcement actions, against Wyndham Hotels and LabMD, there have been significant regulatory developments in the cybersecurity arena. The Third Circuit upheld the FTC’s authority to allege that unreasonable data security practices are unfair. The 11th Circuit told the FTC to make its orders more concrete. Other federal agencies, like the CFPB and SEC, have brought significant actions, with the SEC issuing proposed cybersecurity rules. Meanwhile, the FTC has issued a new Safeguards Rule for financial institutions, raised questions about security in its “Commercial Surveillance” ANPR, and continued to bring dozens of enforcement actions. Sit down with the lead FTC litigators of Wyndham and LabMD to discuss war stories, lessons learned and implications for future regulatory activity.
