Wilson Sonsini Litigation Of Counsel Samantha Machock will speak on a panel titled “Class Actions—Beyond 23(b)(3)” at the American Bar Association’s Litigation Section Annual Conference at 1:15 PM CST on Thursday, May 1. The panel of plaintiff and defense bar practitioners will get attendees up to speed on some of the hottest procedural and ethical issues in current class action practice and offer insights from both sides of the “v.” Topics include:

  • FRCP 23(b)(3) damages classes and “predominance” disputes
  • “Issue” classes when a damages class can’t be certified
  • Whether “fail safe” classes are allowed
  • When a defendant class makes sense
  • The viability of proposals for “negotiation classes”
  • What practitioners and courts are doing to address fraudulent settlement claim submissions

The conference brings together top litigation professionals from across the U.S. to discuss timely legal issues and the latest in trial advocacy, litigation strategy, and case management. The event provides a unique opportunity to learn and interact with in-house counsel, outside counsel, academics, government employees, and judges.

Samantha Machock is a partner in the San Diego office of Wilson Sonsini Goodrich & Rosati, where she is a member of the internet strategy and litigation group. Samantha’s practice focuses on representing technology and healthcare companies in complex, high-stakes consumer class and mass actions, particularly those involving cutting-edge consumer protection, false advertising, privacy, and cybersecurity-related claims. She has secured victories for her clients on a wide range of dispositive motions and class action issues: Recent victories include dismissal of claims against a generative AI service for allegedly misleading users, dismissal of a putative TCPA class action, and dismissal of claims seeking to create novel privacy rights for drivers under California’s Unfair Competition Law. Samantha is currently lead counsel for YouTube and Google in hundreds of cases alleging youth addiction and other harms as a result of YouTube’s design.
