Update on the FTC’s Final Amendments to the Children’s Online Privacy Protection Act and the Implications for Websites, Apps, Ad Networks, and Plug-ins

Our next session explores the FTC’s recent amendments to the Children’s Online Privacy Protection Act (COPPA) and how these amendments might affect your organization.

On December 19, the FTC announced the final amendments to the COPPA Rule, which governs the online collection of personal information from children. The FTC commenced a review of the rule in 2010, citing the need to keep pace with evolving technologies and the changes in the ways children use and access the Internet, including the increased use of mobile devices and social networking. With its recent amendments, the FTC has substantially broadened the type of information for which websites and online services must obtain parental consent, and imposes new obligations on both websites and third parties such as advertising networks and plug-ins operating on those websites or online services.

Our experts will focus on the following topics:

  • What new types of information will be covered by the COPPA Rule, including what companies need to know about collecting persistent identifiers, photos, and geolocation data from kids 
  • What new risks and obligations companies face with regard to the data collection practices of third parties operating on their websites, apps, or other online services
  • What new risks and obligations third parties such as ad networks and plug-ins face when their technology is used by websites, apps, or other online services directed to children
  • When websites, apps, or other online services directed to children can age screen users instead of obtaining verifiable parental consent for all users 
  • New methods of providing notice and obtaining verifiable parental consent
  • New confidentiality, data security, and data retention obligations for websites, apps, and other online services subject to the COPPA Rule
