Doug Carsten Honored Among Daily Journal's "Top Intellectual Property Lawyers" in California

On April 18, 2018, the Daily Journal named WSGR partner Doug Carsten to its 2018 list of the "Top Intellectual Property Lawyers" in California. The publication created the annual list of the state's leading patent, trademark, and copyright lawyers after reviewing nominations from members of the legal community and its own editors and reporters.

In the accompanying profile, Doug was recognized for recently helping Mylan show clear and convincing evidence that patents for eye drop formula Restasis, which are owned by Allergan, weren't valid due to the obviousness of the formula being patented. Allergan originally filed a lawsuit against a number of pharmaceuticals, including Mylan, that had produced their own variants of the eye drops. In addition, Doug is noted for scoring a win on behalf of Amphastar Pharmaceuticals when a federal jury in the District of Massachusetts ruled in favor of the company in a patent infringement suit. In 2011, Momenta Pharmaceuticals and Novartis AG's Sandoz unit sued Amphastar for infringement. The jury returned a verdict in 2017, finding that the patent was invalid due to a lack of enablement and lack of adequate written description.
