3. CBS, Inc. v. Waters, C.D. Cal. No. CV-79-2559-MML. Action for copyright infringement and unfair competition of "bootleg" records (Bruce Springsteen, Cheap Trick). Obtained statutory damage award of over $2 million for willful copyright infringement. 1979-1981.

Represented successful defendant/appellant in computer software copyright infringement action regarding the copyrightability of spreadsheet menu command hierarchies. 23. Magnacoustics Inc. v. Resonance Technology Co., C.D. Cal. No. CV-93-1052-JSL. Represented accused infringers in a patent case involving a magnetic resonance imaging compatible audio system, U.S. Patent No. Re. 34,219. Testified on behalf of clients at September-October, 1994 trial to support invalidity and non-willfullness defenses. Jury found the asserted claims invalid and that clients did not willfully infringe the patent. 1992-1994.

Represented patent owner in case involving patent for differential software distribution over a network, U.S. Patent No. 5,581,764. Also represented accused infringer in a case between the same parties involving another software distribution patent, U.S. Patent No. 5,919,247 (N.D. Cal. No. CV9920894JW). Court rejected Marimba's inequitable conduct defense in a bench trial held in November, 1999. 1997-2000.

Represent accused patent infringer/trade secret defendant and patent owner counterclaimant in case involving DC-to-AC inverter circuits, including U.S. Patent Nos. 6,114,814 and 6,316,881 (offensive) and U.S. Patent No. 6,259,615 (defensive). Obtained summary judgment of non-infringement on the '615 patent, affirmed on appeal, 467 F.3d 1355 (Fed. Cir. 2006).
