| EXPERIENCE: Since joining the firm in 1993, Michael Barclay has specialized in the fields of patent and intellectual property litigation, with a particular focus on electronics-related areas. Michael has litigated patent, trade secret, copyright, and trademark cases in a wide variety of fields, including semiconductors, computer software, graphics, disk drives, cable TV descramblers, ink jet printers, photocopier sorters, and "bootleg" records. Among other cases, he worked on the successful First Circuit and Supreme Court appeal in Lotus v. Borland. Beyond litigation, he provides clients with pre-litigation counseling and opinions in intellectual property matters. Among other activities, he served for five years as a judge pro tem in the small claims division of the Los Angeles Municipal Court and, before entering the legal field, was an engineer at Hughes Aircraft and Intel Corporation. Represented Network (McAfee) Associates in defense of patent case involving a virus detection patent - Novadigm, Inc. v. Marimba, Inc.
Represented patent owner in case involving patent for differential software distribution over a network - Oak Industries, Inc. v. Zenith Electronics Corp.
Represented accused infringer in cable TV patent cases involving important decisions regarding contributory and inducing infringement, and the damages available for reexamined patent claims - More cases
